Official Rules

THE "VAMPIRE DIARIES PRIZE PACK" SWEEPSTAKES is sponsored by KDAF-TV/The 33 ("Sponsors") whose joint decisions regarding all aspects of the give-away shall be final and binding in all respects. 

HOW TO ENTER:  NO PURCHASE NECESSARY.  Viewers can go on-line to www.the33tv.com/vampirediaries and register for a chance to win. Incomplete or late entries will be disqualified, and Sponsors are not responsible for faulty internet connections, unavailability of servers or any other technical malfunctions.  Only entries complying with the entry rules shall be counted in the Sweepstakes. Entries become the property of KDAF-TV/The 33 and will not be returned.  Odds of winning depend on the number of entries received.    


SWEEPSTAKES DATES:  This Sweepstakes begins Tuesday, December 15, 2009 at 8:00am and ends Monday, December 21, 2009 at 11:59:59pm ("Contest Period").  


WINNER SELECTION AND NOTIFICATION:  One (1) Sweepstakes winner will be selected in a random drawing on Tuesday, December 22, 2009 from among all eligible entries.  Winner will be notified by e-mail that same day.  Winner must acknowledge notification within 24 hours.  WINNER MUST CLAIM PRIZE AT KDAF STUDIOS, 8001 JOHN W. CARPENTER FREEWAY, DALLAS, TEXAS  75247.


KDAF-TV/The 33 will be the sole and final judge of eligibility, winner verification and all other matters connected with the contest.  Winner must meet and agree to all eligibility requirements, terms and conditions mentioned in Official Rules.  If a winner cannot be contacted or reached during the first notification attempt, declines the prize, or is deemed ineligible to participate, then he/she will be disqualified and Sponsors may choose an alternate winner.


PRIZE: One (1) Winner will receive a "Vampire Diaries Prize Pack" which includes his/hers Vampire Diaries t-shirts, Vampire Diaries breath mints, Vampire Diaries dental floss, Vampire Diaries sunscreen, "After-Bite" insect spray, a Killers "Day & Age" CD and Vampire Diaries temporary tattoos. Federal, state and local taxes, if any, are the responsibility of the winner, who will receive a 1099 tax form reflecting the actual value of any prize value of $600 or more. 


Prizes cannot be assigned, transferred, changed or redeemed for cash value. No substitutions of prizes permitted unless prize cannot be awarded as described for any reason. The winner must accept prize as awarded and be available on the date to attend the show specified or the prize will be forfeited and a new prizewinner will be selected at random from all eligible entries. Prizes must be claimed within 45 days of notification or they will be forfeited and given to the next eligible entrant.


ELIGIBILITY RESTRICTIONS:  This sweepstakes is void where prohibited or restricted by law.  To enter, you must be 18 years of age or older and reside in the Dallas/Ft. Worth television market in Texas.  Winners under 18 years old must have their parent or legal guardian sign sweepstakes release forms


Employees of KDAF-TV/The 33, Tribune Broadcasting Company, their subsidiaries, affiliates and advertising agencies are not eligible to win. Such employees' immediate family and household members also are ineligible to win.  Winners who have won any prize from KDAF-TV/The 33 within the last 30 days are ineligible and will be disqualified.  Individuals may qualify and participate only once during sweepstakes. 

CONDITIONS OF ENTRY:

1. Use of winner's name:  By entering, each entrant grants permission, without further compensation, to sponsors and their agents and licensees, to use the entrant's name, voice, photograph, likeness and biographical material for broadcast and promotional purposes in connection with the contest.
2. Execution of Affidavit and Release:  By entering, each entrant agrees that if selected as the winner, he/she will sign a release and waiver of liability.  The prize will be forfeited and awarded to another entrant if the winner does not execute the prepared form of release and waiver or if the selected winner is not eligible in accordance with these rules.
3. Release Station and Sponsor of Liability:  By entering, entrants agree to release Sponsors' respective officers, directors, employees, franchisees, licensees, representatives & agents from any claim, loss, liability, damage or injury of any kind arising from the entrants' participation in this Sweepstakes or their receipt or use of any contest prize won.  Sponsors shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including without limitation, damage to personal property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize by winner.  
4. No Prize Substitutions:  No substitute prizes are available; however, sweepstakes sponsors may, at their discretion, substitute prizes of equal or greater value.   Prize is non-transferable and has no cash equivalent.
5. No Warranties:  By entering, each entrant agrees and acknowledges that Sponsors have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relating to any of the prize items, including but not limited to, the quality, merchantability, habitability, mechanical condition, or fitness of the prize items.

INTERNET/FORCE MAJEURE:


If for any reason, this sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the sweepstakes, Sponsors reserve the right, in its sole discretion, to terminate or suspend the sweepstakes or any portion of the sweepstakes. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS SWEEPSTAKES WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES.  Information submitted in Internet entries, including entrant's name, address, e-mail address, etc, shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules and with The 33 online privacy policy, which can be found at the33tv.com.  Sweepstakes shall be governed and enforced pursuant to Texas law, excluding choice of law provisions.
